OB Custom

Welcome to OB Custom. These Terms and Conditions ("Agreement") govern your use of obhawaii.com, specifically "OB Custom" and "studio.b" the website, custom order service, and design/inquiry software platform operated by Out of Bounds Golf Company LLC, doing business as OB Hawaii ("we", "us", or "our"). By accessing or using our website or custom order services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this Agreement, please do not use the website.

Order Process

Inquiry and Data Collection Forms

To start a custom order, you must complete an inquiry form. This form collects necessary personal and business information for processing your request. For Level 1 or Level 2 artwork, use our Studio.b software for submissions. If contacting us outside our website, we'll provide a link to the appropriate form.

Design Phase

Level 1 & 2: Submit your design ideas via Studio.b. Initial designs are not guaranteed acceptance based on our

current capacity. Our artists will refine accepted designs into near print-ready mockups, typically within 5-7 days.

Level 3: Our team will schedule a discovery meeting and possibly additional design sessions. Artwork in 1-2 weeks.

Order Submission and Approval

After design approval, you'll receive a link to submit your order qty's and sizes. We encourage you to submit your order to us through the link, to expedite our order process.
Once submitted to us, we will send you the Final Order Quote, and Final Order Artwork for you to review. We ask that you review all order details as well as the artwork, to ensure your order is properly processed. This is your final chance to review your order, and once we process your approval, your order will be considered to be "committed". (Typically processed in 24-48 hours)

Order Commitment and Production

"Committed" orders are final. We cannot guarantee and changes, revisions, cancellations, or refunds once committed.
Orders enter production with varying timelines. While we aim to meet all requested due dates, we cannot guarantee delivery by these.

Delivery and Payment

Free Delivery is available for orders on Oahu, Hawaii. We will coordinate delivery or pickup. For shipments, shipping costs are added to order totals prior to shipment being sent. Full Payment is due upon or before delivery/shipping. Special arrangements for NET payment terms cam be discussed.

Refund Policy

Final Order Approvals

No Refunds or Changes: Once your Final Order Approvals are processed (24-48 hours from submission), we do not offer refunds, returns, size exchanges, or cancellations. Once orders are processed, you will be agreeing that all information regarding your order, including artwork, is correct and Full Order Payment is required to be paid prior to or upon fulfillment.

Modification Window

To modify or cancel a custom order, please contact order@obhawaii.com within 48 hours of submitting your Final Order Approvals. We do not guarantee that requests will be met.

Errors by OB

In the event of damaged goods or errors on our end, we will replace the products or refund, based on your preference.

Assurance

We understand the uniqueness of each order. While we maintain strict policies, we are committed to flexibility and ensuring you receive the highest quality product tailored to your specifications.

Shipping

All Shipping methods do not include Processing Time.

Custom Orders will be shipped within 5-6 weeks of Final Order Approvals.

Because each Custom Order is unique in destination, size and weight, we will ship using the most cost efficient method unless otherwise noted.

Estimated Shipping Times

Inter-island shipments are delivered approximately 2-3 days from shipment.

U.S. mainland shipments determined on a per order basis to ensure we find the best shipping option for both parties.

Carriers / International

All U.S. orders are shipped via UPS, USPS or Fedex. All international orders are shipped via UPS, Fedex or DHL. Carriers are typically selected based on the most efficient delivery. International customers are responsible for customs duties and/or brokerage fees in addition to shipping costs assessed during checkout.

Payment Policy

Agreement

No downpayment is required for orders to begin. Clients may opt to pay the artwork fee upfront. Full payment for the order is due prior to or upon delivery/shipment, except for clients with pre-approved NET payment terms.

Fees

Artwork Fee: Determined by Level of customization. Current fees are updated on the main OB Custom page. Artwork fee is a one-time payment that you may choose to pay upfront, or have it added to the Order Total.

Additional Branding Fees (if applicable): Will be applied to the Order Total. To see what branding is included, and for full details on our additional branding pricing, check out the "Pricing" link in each Level's custom webpage.

Additional Artwork Revision Fees (if applicable): Will be applied to the Order Total. Each custom order includes 3 rounds of revisions free of charge. Details for additional artwork revision fees can be found under each Level's custom webpage.

Taxes, Shipping, Processing

Sales Tax: Included in polo price.

Credit Card Processing Fee: 1.5% added to order total for payments by credit card.

Shipping Fees: Calculated and added upon shipping (if applicable).

Warranty

Product Life: Our polos are constructed to last through normal performance wear and tear. We do not cover polos that are damaged after polos are worn. To maximize the polo's life, machine wash cold, hang dry, do not bleach, do not iron.

Covered Damages & Defects

Damage Upon Delivery: If any product arrives damaged due to shipping or manufacturing defects, we will take

full responsibility.

Printing/Manufacturing Defects: Defects such as incorrect printing, color shifting, or sewing issues will be evaluated

on a case-by-case basis.

Notification

Contact us: Email order@obhawaii.com within 48 hours of receiving your order with any information, photos, to show product damage or defects.

Resolution

Our Commitment

Refund/Replace: If it is determined that your product is damaged or defected upon delivery, we will be able to refund you for the item(s), or replace the item(s) given that we have extra inventory on hand.

We are dedicated to delivering the highest quality custom products tailored to your needs. While we strive to meet every due date, we understand that unforeseen circumstances can arise. In the rare event we miss a deadline, we are committed to working flexibly with you to find a resolution that minimizes any inconvenience. Our commitment extends to handling any order errors, damaged, or defective products with openness and flexibility, ensuring satisfaction through replacements or refunds. Above all, our goal is to provide you with not just a custom polo, but an experience of quality and care, reflecting our dedication to excellence in every stitch and print.

Limitation of Liability

In no event shall Out of Bounds Golf Company LLC or its suppliers be liable for any damages (including, without

limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the

materials on obhawaii.com, even if Out of Bounds Golf Company LLC or an authorized representative has been notified

or in writing of the possibility of such damage.

Indemnification

You agree to indemnify, defend, and hold harmless Out of Bounds Golf Company LLC, its affiliates, licensors,

and service providers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or

arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

Changes to Terms

Out of Bounds Golf Company LLC may revise these Terms at any time by updating this posting. You should visit this

page periodically to review the Terms, as your continued use of the site after changes are posted constitutes your

acceptance of those changes.

Miscellaneous

This Agreement shall be governed by and construed in accordance with the laws of the State of Hawaii, without

regard to its conflict of law principles.

Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, video clips, music, and written and other materials that appear as part of this Site (collectively, the "Contents") is the property of Out of Bounds Golf Company LLC or its content suppliers and is protected by international copyright laws. The compilation (meaning the collection, arrangement, and assembly) of all content on this site is the exclusive property of Out of Bounds Golf Company LLC and is also protected by international copyright laws.

The Contents of the Site, and the Site as a whole, are intended solely for personal, non-commercial (other than for the purchase of merchandise from the Site) use by the users of the Site. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents, the Site, or any related software.

Intellectual Property Rights

Out of Bounds Golf Company LLC owns and retains all proprietary rights in the website and the Service,

including but not limited to, patents, trademarks, and copyrights, except for the rights that are expressly granted

to you in this Agreement.

Correction of Errors and Inaccuracies

The information on the Site may contain typographical errors or inaccuracies and may not be complete or current. Out of Bounds Golf Company LLC. therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time with or without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing, product availability or otherwise. We apologize for any inconvenience this may cause. If you are not fully satisfied with your purchase you may return it in its original condition, with the original packing receipt within 14 days of the order date, subject to compliance with all other terms and conditions of OB's Return Policy. Please refer directly to that policy for additional information.

User Accounts

You may be required to register an account to access certain features of our site. You agree to keep your password

confidential and will be responsible for all use of your account and password.

Disclaimer of Warranties

No warranties unless otherwise noted by Out of Bounds Golf Company LLC., or agreed upon by both parties for custom orders, collaborations, fundraisers, events, or other. The website and all content are provided on an "as is" basis

without warranties of any kind, either express or implied, including, but not limited to, warranties of title,

non-infringement, or implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

In no event shall Out of Bounds Golf Company LLC or its suppliers be liable for any damages

(including, without limitation, damages for loss of data or profit, or due to business interruption)

arising out of the use or inability to use the materials on obhawaii.com, even if Out of Bounds Golf Company LLC

Whether you're securing a piece from our current stock or placing a pre-order for an upcoming release, we're committed to providing a seamless shopping experience. Limited Releases and Pre-Orders

Limited Online Releases (Drops)

Availability: Our limited edition drops are released in strictly limited quantities. Once sold out, these items will not be

re-stocked, until a later date, but not guaranteed.

Processing Time: Orders for limited releases are processed within 3-5 days from the date of purchase.

Delivery: Expect your items to be delivered within 7-10 business days from the shipping date, depending on location.

Pre-Orders

Pre-Order Window: Pre-orders for releases, collaborations, or fundraisers are typically open for 1-2 weeks.

Details for each pre-order will be specified on the product page.

Processing: Pre-order items are processed once the pre-order period closes. Orders are then processed in 5-7 days. This ensures we can accurately gauge production needs.

Production Time: After the pre-order window closes, allow 4-5 weeks for production.

Delivery: Expect Delivery of your order in about 4-5 weeks from the pre-order closing date.

Order Actions

All Online Orders: Any order action request such as making changes to your order and canceling your order, must be made within 48 hours of the date your order was placed.

Disclaimer: Submitting a request does not guarantee approval. Several factors, such as timing, available inventory, and the status of the item (e.g., final sale), must align for the request to be fulfilled.

Refunds

All sales, whether for limited release drops or pre-orders, are considered final unless an order action request is submitted within the 48-hour request window.

Refunds are offered for damaged, defective, or incorrect orders, as well as orders that have been lost in transit.

We do not refund any order if your received order matches the order information submitted.

All Refund Claims must be submitted within 48 hours of order delivery.

Exchanges

For size exchanges, email us promptly. Due to the limited nature of our products, we have a very restricted amount

of size variations available. Exchanges are not guaranteed and will be processed based on availability.

Returns

Returns are accepted only for products that are damaged, defective, or incorrect. Upon receiving your order,

if you notice any issues, contact us immediately. We will confirm the issue and then proceed with the return process.

Cancellation

All Online Orders: Cancellation requests must be received within 48 hours of placing your order. After this period, cancellations are not possible due to processing.

Disputes: File for a refund directly from your order summary received after purchase, or email us to setup a refund. Refunds take 5-7 days to process.

Sales Tax: 4.5% Sales Tax added to order total

Shipping: Calculated upon checkout.

Security and Encryption

PCI Service Provider Level 1: Your data, privacy, and payment methods are encrypted and transmitted securely through our Stripe payment processor services, with mutual Transport Layer Security (mTLS) for encryption.
